Contest Rules

These General Rules, in addition to any contest-specific rules (the “Specific Rules”), shall govern all contests (each a “Contest” and, collectively, “Contests”) conducted by Mt. Wilson FM Broadcasters, Inc. (“Mount Wilson”), the licensee of KKGO-FM, Los Angeles, California (“Station”), including without limitation Contests conducted on-air, online, or through text, messaging, or social media platforms. In the event of a conflict or inconsistency between these General Rules and any Specific Rules, the Specific Rules shall govern.

Any individual who enters, attempts to enter or in any way participates or attempts to participate in a Contest agrees to be bound by these General Rules and any Specific Rules, as well as by all interpretations of the rules by Mt. Wilson and by all other decisions of Mt. Wilson, which are final and binding in all matters relating to the Contest.

1. No purchase is necessary to enter or win. A purchase will not improve your chances of winning. The odds of winning depend upon the number of eligible entries received and/or the number of participants in the contest.

2. The Contest is subject to all applicable federal, state, and local regulations. Void outside the State of California and where prohibited by law.

3. Contest Entry. Only one (1) entry per person per Contest unless noted stated in the Specific Rules. Only one (1) entry per household per Contest. Winners are not eligible to participate in any Contest for a period of sixty (60) calendar days from the date of winning a Contest conducted or sponsored by Mount Wilson.

Participants must be legal residents of California, at least eighteen (18) years or older, unless otherwise specified in the Specific Rules, and must have a valid California ID and U.S. Social Security Number as of the date and time of entering any contest. Participants acknowledge that if they enter any Mount Wilson contest under a fraudulent name and/or social security number, they will automatically be disqualified from the Contest and any future Contests on any Station, www.gocountry105.com, www.unforgettable1260.com, or any other station or website affiliated with Mount Wilson.

Employees, contractors, officers, or directors of Mt. Wilson, its affiliates, subsidiaries or parent companies, or any prize supplier or entity directly involved in the development or administration of the Contest or any other broadcast company serving the Station’s market, and the members of their immediate families (defined as spouse, parents, siblings, children, grandchildren, including “in-laws” of each) and households are not eligible to enter or win any Contest. In the event that Mount Wilson becomes aware after a winner has been declared that the winner has any of the above affiliations, the winner will be disqualified immediately and the prize will be revoked. In the event of such disqualification, Mount Wilson may, in its sole discretion, award the prize (or any portion thereof) to an alternate winner, award the prize (or any portion thereof) in another contest, or not award the prize (or any portion thereof). The term “household” includes all persons residing together in a single residence, whether or not related.

Participants are required to provide truthful information and the Station will reject and delete any entry that it discovers or suspects to be false, fraudulent, or incomplete. Entries, and all information contained therein or transmitted therewith, become the sole property of Station and will not be returned or acknowledged. Entries that, as determined by Station in its sole discretion, are indecent, lewd, offensive, defamatory, profane, or are otherwise objectionable, or that contain material that may infringe upon any third party’s intellectual property rights, will be disqualified.

Where applicable, entries will be deemed made by the “authorized account holder.” The “authorized account holder” is, as applicable, the natural person assigned (a) an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address; (b) a social media account by the social media platform (e.g., Facebook); and/or (c) the text or mobile telephone number by a telecommunications provider, or other organization that is responsible for assigning such numbers. Participants may be required to show proof of being the authorized account holder. Participants are not permitted to share email addresses, social media accounts, or phone numbers.

4. Method of Entry. Use of any mechanical or automated system to enter or participate is prohibited and will result in disqualification. Station is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected entries. Participants listening to the Station via an Internet stream (including via a mobile app) are advised that there is an inherent technical delay between the time that an announcement is spoken on the air and the time that the announcement is heard on the Internet stream. Therefore, depending on the operation of the Contest, persons listening to the Station via an Internet stream may be at a disadvantage with respect to entering or participating in any Contest over those contestants listening over the air, in that they may impacted by such delay. Unless otherwise specified by the Specific Rules, the following terms shall apply to each method of entry as described:

On-air contests: For on-air Contests conducted by telephone or text message, the Contest will begin as soon as the announcer announces on-air the number the participants must call or text to win the Contest. Calls from participants are taken in the order that they are received. In the event that more than one voice is heard on the telephone line, the winner will be the first person to speak. If the judge(s) or announcer is not able to determine which caller was first, a random drawing between the disputed callers will be held to determine the winner. All persons that call in for on-air Contests must be available for a return call by telephone at the number left on the Mount Wilson contest line. If a participant is determined to be the winner by the announcer but does not answer the return telephone call, they will be disqualified and the next numerical participant will be designated the winner. If winners are announced on-air and are told to call back within a certain amount of time to claim a prize, they must call the announced Mount Wilson contest line within the specified time frame to claim the prize. If the time lapses, the winner will be disqualified. If the announcer asks listeners to text in to win, the designated texter will win. Standard text messaging rates apply for any text contests. Text-messaging may not be available through all wireless carriers. Mount Wilson is not responsible for any landline or cellular telephone malfunctions during the course of any contest. Mount Wilson does not assume any liability for faulty, mis-transcribed, misdirected/misdialed telephone communications or technical difficulties experienced by callers throughout the call-in portion of any contest.

Mail/facsimile contests: To enter a Contest via mail or facsimile, participants must complete and submit all the information required by the terms of the Contest in their original entry. Only one (1) entry per person will be accepted unless otherwise specified on-air or in separate contest rules. Winning entry(s) will be drawn at random from all valid entries received. Mount Wilson is not responsible for late, misdirected, lost or mutilated mail, entry forms or faxes. No liability is assumed for any malfunction of computer equipment, fax machine equipment or fax machine telephone lines. If an entry is illegible or does not supply all information deemed necessary to declare a winner, the entry will be deemed invalid and another entry will be selected.

Internet contests: To enter an online Contest, participants must complete and submit all the information required by the terms of the Contest in their original entry. Only one (1) entry per person for each contest unless noted otherwise. Winning entry(s) will be randomly selected from all valid entries received. Mount Wilson does not assume any liability for any malfunction of the internet or individual computer systems. If an entry is illegible or does not supply all information deemed necessary to declare a winner, the entry will be deemed invalid and another entry will be selected. When entering a contest via an advertiser’s web banner or logo hyperlink, Mount Wilson is not responsible for prize fulfillment or any aspect of the contest. Mount Wilson is simply a “link” to that advertiser’s site.

5. Verification of Potential Winner. Potential Contest winners are subject to verification by Mount Wilson, whose decisions are final and binding in all matters related to the Contest. The potential winner must continue to comply with all terms and conditions of these General Rules and any Specific Rules and winning is contingent upon fulfilling all eligibility and other requirements. The potential winner may be required to sign and return to Mount Wilson, within the time period specified by Station, a winner declaration, an affidavit of eligibility, a liability/publicity release, IRS and/or California state tax forms, and/or any other Contest-related documents provided by Mount Wilson. Such documents must be signed and returned in order for a potential winner to claim a prize. Potential winners may be required to provide copies of legal documents showing California residence and the winner’s Social Security Number in order to claim a prize. If a potential winner cannot be contacted, fails to sign and return any required documents within the required time period, or otherwise fails to reasonably communicate with Mount Wilson, the potential winner will be deemed to have forfeited the prize. In the event that a potential winner is disqualified or forfeits the prize for any reason, Mount Wilson may, in its sole discretion, award the prize (or any portion thereof) to an alternate winner, award the prize (or any portion thereof) in another contest, or not award the prize (or any portion thereof).

6. Prizes. Unless otherwise specified in the Specific Rules, the winner of any Contest must claim any prizes awarded in any Contest by contacting the Mount Wilson promotions department by phone or e-mail within fourteen (14) calendar days after notification of winning. If a winner fails to contact the Mount Wilson promotions department by phone or e-mail within fourteen (14) calendar days, the winner forfeits the prize and no other prize will be awarded in its place. If a winner cannot be contacted or is disqualified, Mount Wilson may, in its sole discretion, award the prize (or any portion thereof) to an alternate winner, award the prize (or any portion thereof) in another contest, or not award the prize (or any portion thereof).

There is no substitution, transfer, or cash equivalent for prizes, except that Station may, in its sole discretion, substitute prizes of comparable value. If a prize becomes unavailable for any reason, Station reserves the right, in its sole discretion, to substitute a prize of comparable value. Prizes are expressly limited to the item(s) specified in the Specific Rules and do not include taxes, gratuities, or any other costs or expenses. Mount Wilson is not responsible for any cancellation, rescheduling, or other modification of an event (including without limitation concerts) conducted by a third party. Any tickets and/or gift certificates/cards awarded as part of a prize will be subject to the terms and conditions set forth by the issuer and are valid only on the date(s) printed on the tickets or gift certificates/cards.

Unless otherwise specified in the Specific Rules, all prizes will be delivered to winners via United States Mail service. No mailings to P.O. boxes. Mount Wilson is not responsible for any lost, stolen, misdirected or damaged mail. Prizes lost or damaged in mailing will not be replaced. Unless otherwise specified in the Specific Rules, all prizes will be delivered within one hundred fifty (150) calendar days after the end of the Contest. All prizes involving tickets to an event or concert will be provided to the winner up through and including the day of the event or concert. Mount Wilson reserves the right to leave tickets for an event or concert at will call at the event or concert and to change how the tickets will be left from mail to will call or will call to mail at any time. For all contests that occur within two (2) weeks of an event or concert, Mount Wilson may require the winner to pick up their tickets in person at the Mount Wilson office.

No more than the stated number of prizes will be awarded. In the event that more than the stated number of prizes are available and/or claimed, Station reserves the right to award only the stated number of prizes. Released Parties (defined below) expressly disclaim any and all warranties of any kind (whether express, implied, statutory, or otherwise), in law or in fact, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. Released Parties shall not be liable or responsible for guarantees or warranties made or offered by advertisers, partners, manufacturers, or suppliers related to any prize.

For prizes involving travel, the winner and his/her guest(s), if any, agree to accept the travel dates specified in the Contest, as applicable. If the winner cannot travel on such dates, the prize will be forfeited. Winners agree to accept all blackout dates, space availability requirements, etc. established by Mount Wilson’s prize partner(s) and/or Contest sponsor, such as hotels, airlines, trains, ships, etc. Winners and guests who accept any trip as a prize do so entirely upon their own initiative, risk, and responsibility. If a prize trip requires traveling outside of the United States, the winner, upon winning the prize, must have and show proof of a valid U.S. passport within fourteen (14) calendar days of notification of winning the prize or the prize will be forfeited. Where a prize allows for the winner to take guests, the guests must be eighteen (18) years of age or older except where the winner is the parent or legal guardian of the accompanying guest(s) and the prize allows for a guest to be under 18 years of age. The winner’s guest(s) (parent or legal guardian, if a guest is a minor) also must complete an affidavit of eligibility and liability release, which must be returned with the winner’s affidavit of eligibility and liability release within seven (7) calendar days of receipt of the forms or the prize will be forfeited. No alternate guest(s) may be substituted once the winner’s guest(s) complete the required paperwork. The winner and his/her guest(s) are solely responsible for obtaining all necessary travel documentation, including by not limited to, any visa requirements and fees. The winner and his/her guest(s) are solely responsible for all costs not expressly included in a prize including, without limitation, any applicable taxes, license fees, additional tours, additional transportation, fuel surcharges, currency charges, all meals, beverages, room service, gratuities, merchandise, medical services, additional lodging, replacement of any lost items, optional travel insurance, etc. If any part of the trip's itinerary does not take place as planned for any reason beyond the control of Mount Wilson, including but not limited to, cancellation, scheduling conflicts, political conflicts or war or an event of force majeure, the remaining components of the prize will be awarded and Mount Wilson’s obligation to the winner will be fulfilled, and no other additional compensation will be provided. Unless otherwise specified in the Specific Rules, any airfare awarded as a prize will be valid for an economy-based fare, flights must depart and return to a major airport specified by Mount Wilson and/or the Contest sponsor in or reasonably near Los Angeles, and ground transportation, baggage fees, or any other costs/fees will not be included. Unless otherwise specified in the Specific Rules, any hotel accommodations awarded as a prize will be based on double-occupancy at a hotel selected by Mount Wilson and/or the Contest sponsor in their sole discretion.

Unless otherwise specified in the Specific Rules, any vehicle awarded as a prize will be delivered with standard equipment for the stated model; any upgrades and options are at the sole expense of the winner. Vehicle may be delivered with reasonable mileage on it. Color, package, factory options, and other specifics are to be determined by Mount Wilson and/or the Contest sponsor and are subject to availability. Winner of any vehicle prize is solely responsible for the taxes, title, registration, insurance (proof of which must be shown prior to winner taking possession of the vehicle along with a valid U.S. driver’s license), at pickup costs at a location designated by Mount Wilson and/or the Contest sponsor.

7. Taxes. All local, state and federal taxes; costs; fees; and expenses associated with a prize or the acceptance and use of any prize are the sole responsibility of the winner. Prize winners are solely responsible for any reporting or payments associated with such taxes, costs, fees, and expenses. All such taxes, costs, fees, and expenses are not included as part the prize. Winners of prizes may be requested to execute and return an IRS Form W-9, as well as any additionally required forms, within fourteen (14) calendar days after receiving such forms or the prize will be forfeited. Winners agree to accept the estimate of the fair market value of the prize provided by Mount Wilson and/or the Contest sponsor.

8. Release. By entering a Contest, participant agrees to release, hold harmless, indemnify and defend Mount Wilson its related and affiliated companies (including without limitation corporate parents and subsidiaries), participating sponsors, prize suppliers and any other entity involved in sponsoring, fulfilling, administering, advertising or promoting the Contest, and each of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, damages, liabilities, losses, expenses, fines, penalties, judgments, demands and defense costs (including, without limitation, actual, direct, out-of-pocket costs and expenses and amounts paid in compromise or settlement and reasonable outside legal fees arising from litigation of every nature or liability of any kind or nature including civil, criminal, administrative or investigative) arising out of or relating to Station’s conduct, administration, or promotion of a Contest; a participant’s entry, attempted entry, participation or attempted participation in a Contest; acceptance, possession, use, non-use or misuse of a prize (including any travel or activity related thereto); and/or the broadcast, publication, exploitation or other use of participant’s name, likeness, voice, city of residence, biographic information, or statements. This release and indemnity shall apply to all claims and liability regardless of whether any insurance policies of the Released Parties or any other parties are applicable thereto, and shall apply regardless of whether or not the claim at issue was caused or alleged to be caused in whole or in part by the party to be indemnified. Winners shall bear all risk of loss or damage to prizes after receipt.

Winners and their guests also agree not to sue or bring a proceeding against any Released Party for any claim or cause of action, whether known or unknown, including without limitation, for personal injury, death, property damage, defamation, invasion of right to privacy, publicity or personality, or based upon or relating to the exercise of any of the rights granted herein or any winner and guests’ participation in a Contest and/or acceptance and/or use of a prize. Under no circumstances shall winners or their guests be permitted to obtain awards for, and participants hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, and winners further waive all rights to have damages multiplied or increased.

All prizes are awarded “as is” and Released Parties do not make (and are not responsible for) any representations, guarantees, or warranties of any kind, express or implied, in fact or in law, relating to any prize (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose), and all such warranties are hereby disclaimed.

If a concert or other event has been awarded as a prize and the concert or event is postponed, rained out, cancelled or for other reasons beyond our control do not occur/exist, Released Parties will not be responsible for replacing the prize. Released Parties will not be responsible for replacing a gift certificate or coupon where the business ceases to exist. To the extent that any prize consists of airline tickets and/or hotel reservations, Released Parties are not responsible for any cancellation, postponement, lost ticket or overbooking. Released Parties are not responsible if any part of a contest cannot be conducted and/or if a prize, either in whole or in part, cannot be awarded due to acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, volcanic eruption, war (declared or undeclared), fire, flood, epidemic, pandemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other factors beyond their control.

The Released Parties are not responsible for: (a) incorrect, incomplete or inaccurate entry information; (b) technical failures of any kind, including without limitation malfunctions, interruptions, defects or disconnections in phone lines or computer networks; (c) unauthorized human intervention in the entry process of administration of the Contest; (d) typographical, technical or human error that may occur in the administration of the Contest or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Contest or receipt or use, non-use or misuse of any prize.

By entering a Contest, participant further understands and agrees that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Participant acknowledges that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The releases herein are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

The Contest is in no way sponsored, endorsed or administered by, or associated with Facebook, X (Twitter), Instagram, or any other social media platform. By submission of an entry, participant releases Facebook, X (Twitter), Instagram, and all other social media platforms from any responsibility or liability for the Contest’s administration, prizes or promotion. Participants are providing entry information to Mount Wilson and not to Facebook, X (Twitter), Instagram, or any other social media platform.

Publicity. Unless prohibited by applicable law, participant authorizes and irrevocably grants to Station and the other Released Parties permission to, from time to time and without further compensation, notice or permission, reference and discuss participant and participant’s participation in a Contest on-air or online (including without limitation in social media); in photographs, video recordings, digital images, or audio recordings; in publications, newsletters, news releases, or other printed or digital materials; and in materials made available in other media now known or hereafter developed. Such reference and discussion may involve use of participant’s name, likeness, or voice, and may involve the disclosure of participant’s personal/biographical information and participants agree to waive any claims to royalty, right, or remuneration for such use and/or disclosure. Each winner’s name may be included in a publicly available winners list.

10. General Conditions. Station reserves the right to cancel, suspend, and/or modify any Contest, in whole or in part, in its sole discretion and for any reason, including without limitation if it learns of or suspects that any fraud, technical failure, or other factor beyond its reasonable control has impaired the integrity or proper functioning of the Contest. Station reserves the right in its sole discretion to disqualify any individual it finds or suspects to be (a) tampering with the entry process or operation of the Contest; (b) acting in violation of these General Rules or Specific Rules; (c) gaining an unfair advantage in participating in the Contest; (d) obtaining winner status using false, fraudulent or deceptive means; or (e) engaging in disruptive, annoying, harassing, or threatening behavior. Disorderly behavior and/or illegal conduct by a winner and/or their guest may result in revocation of a prize either before prize fulfillment and/or during the fulfillment of the prize, including but not limited to, during a concert or on a trip. If the winner and/or their guest have their prize revoked during fulfillment of the prize, both the winner and the guest will be asked to leave. Winner and/or guest will be responsible for any and all costs once the prize has been revoked. Mount Wilson, the tour operator, or the business providing the prize will make the determination if disorderly and/or illegal conduct warrants prize revocation. Any decision to revoke the prize for the above conduct is considered final. Any attempt by any person to deliberately undermine the legitimate operation of a Contest may be a violation of criminal and civil law and Station reserves the right to seek damages from any such person to the fullest extent permitted by law. Station reserves the right to correct typographical, printing, or clerical errors in any Contest‑related materials. Mount Wilson retains the right to amend these rules at any time for any reason. Mount Wilson reserves the right to substitute prizes of equal or greater value upon notice or change to the contest rules. Any ties, disputes, conflicts, questions or concerns regarding Mount Wilson’s contest and/or the associated prizes will be handled by the Director of Marketing for Mount Wilson, whose decision is final and indisputable. Any third-party trademarks mentioned herein are the property of their respective trademark owners. The use or mention of such third-party trademarks in these Official Rules or in a Contest is solely for descriptive purposes and shall in no way imply an endorsement or sponsorship of the Contest. Where a word is defined herein, references to the singular shall include references to the plural and vice versa. Words denoting any gender include all genders. Station’s failure to enforce any term of these General Rules or Specific Rules shall not constitute a waiver of that provision.

11. Choice of Law. These General Rules and all Contests conducted by Mount Wilson are governed by and controlled by the laws of the State of California, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the State of California, Los Angeles County. The parties consent to the jurisdiction of the state courts of California and the federal courts located with such state and county with respect to any action, dispute or other matter pertaining to or arising out of these rules and all contests. By entering any Mount Wilson contest, participant acknowledges and agrees that: (a) any and all disputes, claims, and causes of action arising out of, relating to, or connected with the contest or prize awarded will be resolved individually, without resort to any form of class action or representative action; and (b) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering the contest but in no event attorneys’ fees.

12. Severability. The invalidity or unenforceability of any provision of these General Rules, including but not limited to the agreement to arbitrate, and any Specific Rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, the rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.

13. Participant’s Personal Information. Mount Wilson will retain the personal data collected from the participant for a reasonable period of time to enable it to send that participant any prize that they have won and to verify that these rules have been complied with, and for accounting purposes. This data may be passed to a third party to enable such third party to fulfill any necessary requirements relating to the award of a prize. Any other use of personal data will be in accordance with, and subject to, Mount Wilson’s privacy policy. Participant may have the opportunity to opt-in to receive emails from third parties. In the event that participant opts in to any available opportunities to receive information from a third party, that may or may not be associated with this contest, participant understands and acknowledges that his/her information will be provided to such third party and may be used by the third party as set forth in the third party’s privacy policy.
